1. Agreement to Terms

By accessing and using VayaVaya services, you agree to be bound by these Terms and Conditions. VayaVaya is operated by ZWP Group Pty Ltd, a company incorporated in South Africa.

2. Description of Service

VayaVaya provides municipal bureaucracy navigation services, including but not limited to:

• Municipal query submission and tracking
• Document preparation and processing
• Escalation management through municipal departments
• Status updates and notifications
• Billing dispute resolution assistance

3. User Accounts and Subscriptions

To access our services, you must create an account and maintain an active subscription. You are responsible for:

• Providing accurate and complete information
• Maintaining the security of your account credentials
• All activities that occur under your account
• Timely payment of subscription fees

4. Payment Terms

Subscription fees are charged in advance and are non-refundable except as required by law. Accepted payment methods include credit cards and electronic funds transfer. Price changes will be communicated 30 days in advance.

5. User Obligations

You agree to:

• Provide truthful and accurate information
• Use the service only for lawful purposes
• Not share your account with unauthorized parties
• Comply with all applicable municipal regulations
• Not interfere with the proper functioning of the service

6. Service Availability

While we strive for 99% uptime, we do not guarantee uninterrupted service availability. Scheduled maintenance will be communicated in advance. We are not liable for service interruptions beyond our reasonable control.

7. Limitation of Liability

ZWP Group Pty Ltd's liability is limited to the amount paid for services in the 12 months preceding any claim. We are not liable for:

• Municipal department delays or decisions
• Indirect, incidental, or consequential damages
• Loss of profits, data, or business opportunities
• Third-party actions or omissions

8. Intellectual Property

All content, software, and materials provided through VayaVaya remain the intellectual property of ZWP Group Pty Ltd. You may not reproduce, distribute, or create derivative works without written permission.

9. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which complies with the Protection of Personal Information Act (POPIA).

10. Termination

Either party may terminate this agreement with 30 days' notice. We may immediately terminate for breach of these terms. Upon termination, your access to the service will cease, but these terms will survive regarding liability and intellectual property.

11. Dispute Resolution

Any disputes will be resolved through:

1. Good faith negotiation
2. Mediation if negotiation fails
3. Arbitration under South African law if mediation fails

12. Governing Law

These terms are governed by South African law. Any legal proceedings must be brought in the courts of Johannesburg, South Africa.

13. Changes to Terms

We may update these terms periodically. Significant changes will be communicated via email or platform notification 30 days before taking effect. Continued use constitutes acceptance of updated terms.

14. Severability

If any provision of these terms is found unenforceable, the remaining provisions will continue in full force and effect.
